The Paralegal Certificate Program

A paralegal or legal assistant “is a person qualified by education, training or work experience who is employed or retained by a lawyer, law office, corporation, governmental agency or other entity who performs specifically delegated substantive legal work for which a lawyer is responsible.”
A paralegal has a limited task that can perform. He cannot represent a client on a trial or accept a case. He cannot also give legal advice. In short, a paralegal cannot perform functions that are considered as a law practice. The paralegal performs some duties of the attorney such as but not limited to conducting and interview to the client, locating witnesses, conducting investigation, legal research, and interviews, drafting legal document, correspondents and pleadings with the supervision of an attorney.
To become a certified paralegal or Certified Legal Assistant CLA, he or she must achieve requirements such as graduating from a paralegal certificate program that is approved by the ABA; “or an associate degree program; or a paralegal post-baccalaureate certificate program; or a paralegal certificate program with 60 semester hours of which at least 15 semester hours are substantive legal courses.” He can also be a paralegal if he or she has any bachelor’s degree plus a one year experience as a legal assistant with a completion of at least 15 semester hours or substantive legal assistant courses. Or he or she could have a high school diploma or equivalent to seven years experience as a legal assistant under the supervision of a member of the Bar.

Some recommend a bachelor’s degree or at least completing 60 semester credit hours, or equivalent, of general education courses for one of any accredited colleges or universities in the country, while some institutions offering the paralegal certificate program accepts applicant which has achieved at least 3.0 GPA.
Either way, entering on a paralegal certificate program is a good start in achieving a wide career in the field that needs a lot of dedication, patience, and discipline.

Paralegal or legal assistant is “a distinguishable person who assists attorneys in the delivery of legal services. Through formal education, training and experience, legal assistant has knowledge and expertise regarding the legal system and substantive and procedural law which qualify them to do work of a legal nature under the supervision of an attorney.”
In the United States, there are more than 120,000 paralegals that have received paralegal certificates that do tasks and become vital members of the legal community. Paralegal are either hired by lawyers, law firms, corporations, governmental agency, or other groups of the same manner.
Paralegals, as a legal assistant have limited task. They could mot represent a client in court not give legal advice. They cannot set fee or accept a case. In short paralegals cannot assume the duties that are set for legal officers only.
However, paralegals can perform tasks under the supervision of the attorney. These can be, but not limited to, conducting client interview without bridging the gap between paralegal and attorney. Paralegals can also conduct survey, investigations, and research whether statistical or documentary. Paralegals can also summarize depositions, interrogatories and testimony. They can also attend hearings and trial with the attorney. And with legal assistance, paralegals can author and sign correspondence but does not include legal opinions.
But becoming must have a formal education about the profession. The Associate Degree Programs, Bachelor Degree Programs, and Master’s Degree Program are some of this. There is also what we can the Certificate Program that is offered to various educational institutions that can be between 16-60 semester units.
Some educational institutions accept student and afterward award paralegal certificates to those who finished at least three semesters in college or 36 units credits. There are also eight courses in legal studies to finish before a paralegal certificate can be given. These are Business Law, Family Law, Introduction to Civil Procedures, Introduction to Criminal Law, Bankruptcy, Real Estate Law, Legal Research and Writing, and Legal Ethics.
Upon completion of the course, but before the awarding of paralegal certificate, the individual is not yet to be called paralegal, because the paralegal certificate can be obtained by standards set by the American Bar Association. The standard requires completion of the Certified Legal Assistant certifying (CLA) examination of the National Association of Legal Assistants. The school that award paralegal certificate should have “American Bar Association approved program of study for legal assistants.” The candidate should first graduate “from a course of study for legal assistants which is institutionally accredited but not ABA approved, and which requires not less than the equivalent of 60 semester hours of classroom study.”
In addition, a paralegal certificate can be obtained he the candidate graduated from “a course of study for legal assistants, other than those set forth in (2) and (3) above, plus not less than six months of in-house training as a legal assistant.” He or she should also have an attained baccalaureate degree in any field with an "in-house training as a legal assistant" not lower than six months. Achieving all these, paralegal certificate is ready to be given.

Technology is a power that drives the world. As lazy creatures, we have surrounded ourselves with the fruit of progress and enjoy our life effortlessly, taking advantage of convenient, helpful, indispensable and irreplaceable machines, created by our hands.
Nowadays we can’t imagine our life without these machines. Let’s take computers, for instance. We can’t get along without them anyway. Eating, drinking, and communicating via computers, at last living with them. They have become our obsession, perhaps because they armed us with the abundance of new, versatile possibilities or just because we’ve got used to them and they’ve become our mechanical toys.
However, computers, especially portable ones, can serve not just as funny toys, but excessively useful tools in our work and study. Studying with the laptop is a dream of every college student. In today’s fast moving world this tool is just indispensable and studying with it can become a real pleasure.

Student Loan Limits Not Keeping Up with Tuition Rates

As tuition rates at many colleges continues to rise, the limits that students may borrow each year has stayed the same.
Dependent undergraduates may borrow up to $2,625 their freshman year, $3,500 their sophomore year and $5,500 for each remaining year in Stafford Loans.
Students classified as independent from parents, may qualify for additional unsubsidized loans. Dependent students may also receive unsubsidized loans if parents do not qualify for a PLUS loan.
Unsubsidized loans can be a double edged sword -- they allow the student to pay for college, but borrowers do not receive the interest free benefit of subsidized loans.
There is also cumulative limit of $23,000 for an undergraduate education.
The limits on amounts students can borrow though federal loans hasn't increased since 1992. In that time tuition rates have more than doubled.
According to finaid.org, tuition rates increase at about twice the general inflation rate. On average, tuition tends to increase about 8% per year. In addition, general inflation has caused prices for student housing, meals and other necessary expenses to increase.
For the school year 2005-2006 many colleges dramatically raised tuition rates. An example of such tuition hikes is the University of Colorado where rates rates have been raised for all of the system's campuses. Tuition at CU-Boulder will go up by 27.8 percent, from $3,480 to $4,446. Other CU campuses will see a similar increase.
The national average tuition for public universities is $4,694 per year for in state residents. For freshmen and sophomore students, the current student loan limit does not even cover tuition costs.
Because of the restrictions with federal student loan limits, students and parents will need to become more diligent in seeking out alternative sources of college funding.
There are many scholarships available nationwide that students can apply for. One of the easiest ways to apply is through the FastWeb online database. There are also many books available that list scholarships that students can apply for.
Part time and summer student employment also becomes more important when education costs rise.
Until the federal government reconsiders raising the student loan limits, students will become increasingly dependent upon scholarships, savings and employment. The lesson for families with children not yet in college is simple -- start saving early.

Supervisor Training: Helpful tips to lead your pack

A new supervisor is hired to anchor a gardening project that has fallen apart. The last supervisor walked out on the job because he was overwhelmed with the high expectations of the project. The new supervisor is in charge of ten teenage workers, five young women and five young men, all of whom are not thrilled to be working on a summer day. As the new replacement, the supervisor is in charge of landscaping the lawn and garden areas that garnish a business complex. The complex manager has informed the supervisor that he has a three hour time limit to mow and trim the lawn areas, weed out the old plants and dead greenery, and replace them with a fresh array of tulip bulbs. By the day’s end, the supervisor has a $20 food budget to feed the 10 workers on their lunch break. The summer heat is burning, and the teenagers would rather be out by the pool. Instead, they are required to sacrifice this day at work. The supervisor is overwhelmed with the task, but motivated to assist with all the responsibilities of his ten employees for the next three hours.
What is this supervisor to do with limited time, resources, and not to mention, controlling ten wild teenagers who are not thrilled to be working while their peers are at play? Good training will assist him in completing his duties as supervisor of the project.
Supervisor training involves motivation. Attitude, incentives and goal-setting will lighten up any burdensome task, and during the hot afternoon, the crew will need the motivation to work.
• Attitude - It is important that the supervisor is optimistic, especially in light of an arduous task. If the supervisor reflects an optimistic attitude, his workers will be easily influenced.
• Incentives - Rewards do not have to be tangible; pats on the back and encouraging words are just as enticing. When the atmosphere is uplifting and when authority is not threatening, workers are more inclined to conform to their surroundings.
• Goal Setting - Making goals will help the supervisor’s crew envision what they need to accomplish in order to be successful. When the supervisor paints a picture of what needs to be done, the goals are specific, and thus, easier to follow.
Supervisor training involves delegation. Delegation converts deadweight into useful energy. From a personal account, I previously worked under a great supervisor who delegated work responsibilities equally and fairly among his workers. He efficiently distributed the work among his resources and that alleviated him from carrying the entire workload. He would make assignments and follow up with everyone to make sure that all tasks have been properly completed.
A supervisor who utilizes delegation will provide positive outcomes for his workers. As workers, their roles are enhanced with responsibilities and they know that their contributions are needed and valued. For example, the supervisor of this gardening project would group individuals to cover different regions of the lawn and would follow up on their progression. This style of supervising allows teams to focus on their assigned area and helps the supervisor to keep track of the equal distribution of work duties.
Supervisor training involves resource management. The supervisor will use the limited resources he has to make this project tolerable. For example, the supervisor knows he will be working with anxious teenagers that have lived up to the motto of no work, all play. That explanation could make him nervous in itself. However, he brainstormed an idea of mixing work with play and encouraged his workers to wear their swimsuits while working. With the sprinkler system turned on, the crew will be able to cool off while working in the heat.
Feeding the hungry teenagers after work will be a challenge with $20 to spend. Depending on what degree of fine dining he wants to go, or how picky or how healthy conscious his workers are or aren’t, starving appetites after a hard working day might override all eating preferences. The supervisor settles in on ordering four large pizzas for $5 each at a local pizza place. The business complex offers employees complimentary beverages and paper goods, so the supervisor takes advantage of that resource to keep morale high.
By the end of the day, the supervisor left with a sense of success and his young workers went home with a full stomach and pride of beautifying the gardens of the business complex. With these supervising training tips in mind, you can turn any laborious task into an enjoyable and learning experience.

Accredited Online Universities - Getting Good Grades

Taking distance education courses requires more motivation and self discipline than traditional college classes. Being able to work at your own pace can result in you falling behind on your work, if you're not self directed. Organization is the most important factor for success in online studies.
Attend the orientation and any study sessions offered by the university, if at all possible. Instructors offer valuable information in these sessions. Utilize on campus resources such as the college library and computer lab. Many schools offer online resources, such as online libraries and tutoring for distance learning students. Take advantage of all resources your school has to offer to get the most out of your education.
Create a schedule with regular times for studying and stick to your schedule. If you are taking more than one class, get a large calendar. Listing all exam and assignment due dates on this calendar makes a great visual aid to help with time management. You can schedule how much time you will spend on each class based on this information. If you have a large paper due this week in one class and an exam next week in another, you can schedule your study time accordingly.
Jump right in and get started on the material. Many successful students get the books early and read the first few chapters before the class starts. If you can get a copy of the class syllabus early, do the first week's work before the class starts. You will be a week ahead of the game when class starts. Try to stay at least a week ahead, whenever possible. Being ahead gives you flexibility if something comes up during the semester to take you away from your work for a few days. If you can't get the syllabus, read a few chapters to familiarize yourself with the material.
Interact often with your instructor to get the most from the course. You can request that the instructor look at your schedule and give you feedback on your progress in the class. Schedule time to participate in online discussions or group projects your program offers. Some instructors require you to post replies on a message board as part of the course. You will be given points for this participation.
As you work your way through the course, follow the syllabus and study guide carefully. Complete all reading assignments and take complete notes on the material you read. Read each chapter when it is assigned. Don't skip the reading and try to catch up before the exam. Reading six chapters two days before the test will result in a lower grade. The same goes for studying. Don't try to study the night before an exam. Study and read a little bit each day for the best retention.
To do well in distance education courses, you must complete all assignments on time. If you have a hectic schedule, try to complete all papers and assignments early. You won't have to worry about something coming up the night before an assignment is due. Working late or having a sick child can throw you off schedule and cause your assignments to be late. Some instructors will give partial credit for late work, while others will give no credit. No instructors give full credit for late work in college.

Online College Programs - How to Apply

The first step to getting your online degree is to apply to colleges. Research several colleges offering the degree program you need. Once you have decided on a school, you are ready to begin the application process. While the requirements may vary slightly, most colleges have similar processes. You will need to fill out an application, either online or on paper. Check with the university for application deadlines. Just about all schools charge an application fee; these fees are usually small.
You will need to include any supporting documentation required by the school where you are applying. You will find this information included with the application. All schools require original transcripts from all schools previously attended. This will include both high school and college transcripts. A few schools look for college preparatory courses in high school. Send your requests early to allow enough time for transcripts to arrive at the college. Some schools will require SAT test scores and immunization records as well.
You will have to meet the admission requirements of the college you will be attending. The requirements vary by school and in some cases can be different based on your major. Be sure to check with the university to determine the requirements. Many schools have a minimum SAT score requirement for admission, although some waive this for some programs or for non traditional students. Non traditional students are defined as older students who have been out of high school for at least five years and have work experience. Students transferring from other institutions are in this category as well.
Many schools require students pass placement tests prior to registering for classes. These tests usually have English, math and writing components. This is to determine if potential students have the reading, writing and math skills necessary to succeed in college. If you don't pass one of the placement tests, you may be required to take remedial courses prior to starting your degree; this is not unusual for people returning to school after many years. Graduate programs will usually require additional testing, such as the Graduate Record Exam (GRE).
When you apply to the school, you can also apply for financial aid. Talk to a representative about programs available to students in the form of financial aid and scholarships. Start the process by filling out the Free Application for Federal Student Aid (FAFSA). Complete the application even if you don't think you will qualify for federal aid. Most other student loan programs use the same application. To be able to accept federal financial aid, the school must be regionally accredited. Accreditation is a voluntary process and matters mainly for financial aid and transferring credit to other universities. Check with an admissions counselor if you're not sure about accreditation.
Once you have completed all applications and testing, you will find out if you have been accepted into the program. Once you have been accepted, you will be eligible to register for classes and begin the journey toward your college degree. The admissions counselor at your university can assist you in scheduling your courses. There is often an order in which classes should be taken. Once you have registered, you pay for your classes, get your books and attend orientation, if required.

The power of a bachelor’s degree becomes even more apparent when seeking employment. Applicants with a degree are much more likely to be hired for a position than those without a degree. Specialized study in college prepares workers for a job field or industry. A general or liberal arts degree will help workers gain employment in a wide range of fields. Often the field the degree is in is not important than just the fact that you have the degree.
Finally, college is a time to explore your interests, talents and grow as a person. The experience you gain working with other students and professors will help you mature and be ready for not just the job market, but for deeper life experiences.

Many college students and graduates are looking for a options for repaying their student loans. While borrowers may be having difficulty paying back loans, there is help available.
What causes difficulty in paying back student loans?
New college graduates may find that it takes them longer to find a job than they expected. While there's a six month grace period from the time students graduate until repayment begins, sometimes it takes six months or longer to find a job.
Many recent graduates who are employed are underemployed -- working part-time or temporary jobs until they find a permanent position. During this time they may need help in making loan payments.
New college graduates can use several strategies to help with student loan repayment. Taking on additional part-time jobs or freelancing may be an option.
It is also wise to keep living expenses low the first few years out of college. Graduates can live with a roommate, or downsize into a smaller apartment. If new graduates are still looking for a job, it may be a good idea not to move until permanent employment is found. Then it will be easier to move to an area closer to the job.
Applying for a forbearance may help during times of difficulty making loan payments. A forbearance is temporary period of suspension of payments on a federal or direct loan after repayment has begun, and if the student does not qualify for deferment.
This means that if a student has already started paying back loans, they can apply for a suspension of payments on the grounds of financial hardship. A forbearance must be applied for through the lender. Being able to hold off payments for a few months can be a big help during a time of financial hardship.
Another student loan debt strategy is to consolidate payments. Unless consolidated, each student loan is accounted for and paid separately. When a student graduates they will receive paperwork and payment slips for each loan. 2, 5, 12... no matter how many loans were taken out, they will be billed separately. Adding up all of these individual loan payments could total $300-$1000 per month or more! Not many students can afford such payments.
That's where consolidation comes in. Consolidation is a process that combines all of the student loans into one loan. Borrowers can dramatically reduce monthly payments of student loans by consolidating. Average monthly payments could be less than $100 to around $250 per month. This is just an estimate. The monthly payment depends on the total amount borrowed, the interest rate and the way that loans are consolidated.
Consolidating through The Income Contingent Repayment plan is designed to help make repaying student loans easier for students who intend to pursue jobs with lower salaries, such as careers in public service. The monthly payment amount is adjusted annually, based on changes in family size and annual income. This program is only available through the US Department of Education, not a lender or bank.
Finally, the Graduated Repayment Plan starts the payments at a low level (usually interest only) and gradually increases the payments until the balance is paid. This is helpful for graduates because payments are low when the first graduate, and increase as earning power increases over the years. This plan is available by consolidating through a bank or other lender.
It is important to note that according to current regulations student loans may only be consolidated once. So borrowers who have already graduated and consolidated with a standard plan cannot take advantage of the income contingent or graduated plans. For borrowers who have already consolidated, a forbearance may be the best option for temporary relief of student loan debt.
